1. Scope
These Terms of Service govern the use of the website china-cars.ch (the "Platform") by visitors and users ("Users").
The Platform is operated by china-cars.ch, Im Sunnebuck 23, 8306 Brüttisellen, Switzerland (the "Operator").
By using the Platform, Users agree to these Terms of Service.
2. Purpose of the Platform
The Platform provides information for comparing Chinese electric vehicles for the Swiss market, including vehicle data, pricing, ratings, articles, and comments.
The Platform does not provide advisory services, does not broker purchase contracts, and does not constitute an offer. No vehicles can be purchased through the Platform.
3. No warranty for information
All information on the Platform (in particular prices, technical data, availability, warranty terms, ranges, and charging performance) originates from manufacturer information, official Swiss importer information, or model calculations and is provided for information purposes only.
The Operator gives no warranty for the accuracy, completeness, or currency of the information. Prices and availability may change at any time.
Charts such as charging curves or winter ranges are illustrative models, not measured values. Before making a purchase decision, Users should verify the information with the official Swiss importers or dealers.
4. No contracts concluded through the Platform
Links to importers, dealers, or marketplaces (e.g. AutoScout24) lead to external websites. Contracts are concluded exclusively between the User and the respective provider.
The Operator is not a party to such contracts and is not liable for the content, offers, or availability of external websites.
5. User content (comments)
Users may publish comments on the Platform. Comments are publicly visible.
Users warrant that their content is lawful and does not infringe the rights of third parties. In particular, unlawful, defamatory, discriminatory, misleading, or promotional content as well as spam is prohibited.
The Operator may remove comments at any time without stating reasons.
6. Intellectual property
The content of the Platform (texts, graphics, logos, trademarks) is protected by copyright and trademark law. Any use beyond personal, non-commercial purposes requires the Operator's consent.
Some third-party images are used under Creative Commons licenses; the credits can be found on the "Image Credits" page.
7. Liability
To the extent permitted by law, the Operator is not liable for damages arising from the use of the Platform or from inaccurate, incomplete, or outdated information.
In particular, liability for indirect damages, consequential damages, and lost profits is excluded. Liability for intent and gross negligence as well as for injury to life, body, or health remains unaffected.
The Operator is not liable for the availability of the Platform; interruptions due to maintenance or technical faults are possible.
8. Changes to these Terms
The Operator may amend these Terms at any time. The version published on the Platform at any given time is authoritative.
9. Governing law and jurisdiction
Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG), to the extent permitted by law.
The place of jurisdiction is the Operator's registered office in Brüttisellen (ZH), unless mandatory legal provisions (in particular consumer protection law) prescribe another place of jurisdiction.
10. Final provisions
Should any provision of these Terms be invalid, the validity of the remaining provisions shall remain unaffected (severability clause).
